1. Agreement to Terms

These Terms & Conditions ("Terms") govern access to and use of Encore (the "Service"), operated by Encore ("we," "us," or "our"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Encore provides DJ companies with tools to manage bookings, host communication, song requests, and day-of event run sheets. Hosts invited by a company using Encore may access a branded portal to interact with that company through the Service.

3. Accounts and Plans

Companies subscribe to one of our available plans, billed monthly or annually. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Plan features, limits, and pricing are described on our pricing page and may change with notice.

4. Billing, Trials, Cancellation, and Refunds

Paid plans may include a free trial period as described during sign-up. Subscriptions renew automatically for the billing cycle selected (monthly or annual) unless cancelled prior to your next renewal date.

Cancellation: You may cancel your subscription at any time directly through your billing settings in the app. Upon cancellation, your subscription will not renew, but you will maintain full access to the Service until the end of your current paid billing period or trial period.

Refund Policy: Except as required by law, all payments are final and non-refundable. We do not issue refunds or pro-rated credits for partial billing periods, unused time, or unused DJ slots.

5. Acceptable Use

You agree not to misuse the Service, including by attempting to access data you are not authorized to view, disrupting the Service, or using it to transmit unlawful, abusive, or infringing content.

6. Content and Data

You retain ownership of content you submit to the Service (such as event details, song requests, and messages). You grant us a license to host, process, and display that content solely to provide the Service to you and the hosts you invite.

7. Termination

We may suspend or terminate access to the Service for violation of these Terms or non-payment. Upon termination, your right to use the Service ends, though certain provisions of these Terms will survive.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Encore will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
